The family of Nancy Toffoloni Benoit, murdered by wrestler Chris Benoit, is in federal appeals court with Hustler Magazine after that publication printed nude pictures of the woman.
The family has argued Hustler had no rights to publish the shots, and was previously awarded $19.6 million by a jury. A judge reduced the penalty to $250,000.
Nancy Benoit’s family is in court to reinstate the larger award, while Hustler claims its publication is covered by the first amendment.
